Auction Terms & Conditions
RETURN POLICY:

FEES:
All items will incur the following fees:
16% Buyer’s Premium
Harmonized Sales Tax (HST)
$1.50 handling fee per item
2% credit card processing fee (credit card payments only)
A Restocking / Abandonment Fee of 35% of the total invoice value will be applied to any unpaid or uncollected invoices, and any garbage or materials left behind will be charged at $10 per box/package and $100 per skid.
PAYMENT:
Payment for all items is mandatory by 9:00 AM on the Friday following the auction. Shipping orders will be charged on Tuesday following the auction after 9:00 AM. Credit card payments will incur an additional 2% processing fee.
If you wish to pay via e-transfer, debit, cash, or another method, this must be indicated in the “notes to auctioneer” before registering for the auction. If payment is not received by 9:00 AM on Friday, the credit card on file will be charged automatically.
E-transfers can be sent to finance@encoreauctions.ca (auto-deposit enabled). A paid receipt will be issued once funds are received.
Refunds are issued based on the original method of payment:
- Credit & Debit → Refunded to the original card
- E-Transfer → Issued as account credit
- Cash payments over $500 → Issued as account credit
Buyers must complete payment within the 5-day pickup window. Failure to do so will result in account suspension and a restocking fee equal to the buyer’s premium plus seller’s commission. Unpaid invoices may also be sent to a collections agency.
We do not accept alternate forms of payment over the phone due to past fraudulent activity.
PICK-UP:
You can pick up your items at 23 Buchanan Court, London, ON during our Customer Service business hours:
Tuesday–Saturday, 10:00 AM–6:00 PM.
All orders require a pickup appointment. An email will be sent to you after your order has been generated to select your appointment time.
Please ensure that all items are collected within 5 days of the auctions closing. If you fail to do so, the items will be considered abandoned, and no refund will be issued as the consignor would have received their payment. Before leaving the premises, please inspect all items and ensure you have taken everything. You can only collect your items with a paid invoice, so kindly ensure that you have paid before attempting to collect the items. All items must be removed within the specified time, and the purchaser shall bear the expense, liability, and risk of removal. If you are unable to collect your items, kindly refrain from bidding. All items are sold as is, where is, with all faults.
If you fail to pick up your items during the posted pick-up hours, your items will be considered abandoned. In such a case, your credit card will be charged for the purchase price of the item and the cost of removing, transporting, and disposing of the item.
Warning: Do not leave garbage or packaging behind. Disposal fees will be charged to your account — $100 per skid and $10 per box/package.
SHIPPING INFO:
For those who want their purchased items shipped, kindly indicate “shipping required” in the “notes to auctioneer” upon registration. All shipping requests are handled by PkgPlace. Please see their site for more details. All shipping requests must be sent to PkgPlace within 3 days of the auction closing.
Please note: Encore Auctions is not responsible for shipping costs related to returns. All return shipping fees are the responsibility of the customer.
GENERAL TERMS:
For security purposes, we may request that you provide a photo ID and credit card when collecting your items. This is simply a precautionary measure to prevent fraudulent activity, stolen credit cards, or chargebacks.
To participate in our auctions, bidders must register with their own credit card and are not permitted to use a credit card that is not in their name. If we find that a registered credit card belongs to someone else, we will deactivate the account to prevent fraud and chargebacks.
Multiples are used when bidding on items with a quantity greater than 1. This means that the bid price will be multiplied by the quantity to determine the total cost. For instance, if the bid price is $10 and the lot has a quantity of 4, then the total cost would be $40.
Please note that once a bid is placed on an item, it cannot be canceled. Only place a bid if you fully intend to follow through with it. We are unable to cancel bids for any reason.
You accept responsibility for your account when you agree to our terms and conditions. If anyone else, such as family members, uses your account without your permission, you (the account holder) are still responsible for paying for any items they bid on. To keep your account secure, never share your password and always log out when you are finished using your computer. Remember, you are solely responsible for your account.
Unfortunately, we are unable to assist with loading your vehicle. If you require assistance, please bring additional people with you. Please ensure that you have collected all of your belongings before departing.
Please note that all items are sold “As Is Where Is” without any warranty or guarantee. Although we believe that all descriptions and commentary are accurate, neither the Auctioneer nor the consignor can provide any warranties or guarantees regarding the property. We cannot be held responsible for any implied or explicit claims made about the item, including its description, authenticity, authorship, attribution, provenance, period, culture, source, origin, or condition.
We regret to inform you that we do not provide shipping services to the United States or sell our products to US residents.
REGISTRATION & IDENTIFICATION:
During registration, we gather your personal information to confirm your identity and authorize you to bid. We also require credit card details to validate your eligibility as a buyer. Please note that all bidders must be of legal age.
REVIEWING YOUR BIDS:
During an auction, you can check the status of your bids at any time. It’s essential to keep in mind that once the auction is over, no bids can be withdrawn for any reason. Additionally, all items are sold as they are, where they are, with any and all faults.
BIDDING NOTIFICATIONS:
If you want, you can receive email notifications when someone outbids you during the auction. However, please remember that you won’t receive any notifications during the last two hours of the sale.
CONDITIONS OF ITEMS SOLD & OUR ONLINE CATALOGUE:
We strive to provide accurate descriptions and photographs of all items, but please note that all items are sold “as is, where is” with any existing faults.
CLAIMS:
Please note that no claims regarding purchased goods will be accepted. Bidders should be aware that all items are sold “as is, where is” with any possible flaws.
PERSONAL & PROPERTY RISKS:
Please note that we cannot be held responsible for any harm or damage caused to people or their belongings.
ADDITIONS & DELETIONS:
Please note that we may make changes to the items available for sale during the auction. This includes the removal or addition of lots and/or items.
BUYERS:
By participating in the auction, the BUYER agrees to protect Encore Auctions, the Seller, and their assigns from any claims, losses, expenses, damages, or liabilities that result from the auction, including any negligent acts or omissions by Encore Auctions Inc or any of its representatives. It is required that all bidders/buyers be of legal age.
AUCTION RECORDS:
If there is a disagreement, you acknowledge that the information we have in our records is accurate and agree to accept it as true.
SOFT CLOSE:
Items in this auction have regularly scheduled closing times. To prevent last-minute “sniping” by bidders, any bids placed within the final minute of the auction will extend the item’s closing time by an additional 2 minutes. This process will continue until all bidding has come to a close.
STRATEGY:
We suggest placing your maximum bid to ensure the best chance of winning an online auction. This doesn’t mean you’ll have to pay that amount, as you’ll only be charged one bid higher than the next highest bidder, up to your maximum bid. Our software will simulate a live auction and only use the necessary funds to beat out the under-bidder at the set bid increment.
CATALOGUE ERRORS & OMISSIONS:
Our policy for resolving discrepancies between item descriptions and pictures in a lot is to use live photos as the primary source of reference for identifying errors. We refer to the item description and stock photo in that order if live images are unavailable. Please note that we sell all items as-is, which means that any existing faults are included in the sale.
